Jointly owned property does not pass automatically to the survivor. The 

“share” in the property will pass in accordance to any instructions that may 

have been left in a Will. If there is no Will, then the property passes in 

accordance with the rules of intestacy. For this reasons it is a good idea to 

make a Spanish Will.


It is not compulsory to have a Spanish Will, however, making one should 

make the probate formalities in Spain simpler and faster.


In most cases it is possible for a person who is not resident in Spain to 

dispose of property situated in Spain through a Will prepared in accordance 

with the law of their home country. However this can lead to complications 

and further expense in the administration of the Estate.
